Fees FOR MEDIATION

My hourly rate for mediation is $450.00, divided pro rata among the parties. This rate applies to the mediation conference and the time it takes me to prepare, including my review of materials submitted by the parties. Please call sufficiently in advance of the mediation to discuss the need for and nature of any pre-mediation submissions. Preparation time is billed only for time spent. The hourly rate for in-person and online are the same. *

You will receive an electronic invoice following the mediation. Please tell your clients in advance of the mediation that I expect them to pay me at the conclusion of the mediation. I accept credit cards and direct bank payment through LawPay, along with Venmo and Zelle.

It is expressly understood between me and counsel for the parties that they, the lawyers, are responsible for paying my fees if their clients Have failed to do so within 14 days from the date of the mediation.

*Minimum Charge – Rule 10.430, Rules Florida for Certified and Court Appointed Mediators requires that “[A] mediator shall schedule mediation in a manner that provides adequate time for the parties to fully exercise their right of self-determination.” I rarely schedule more than one mediation per day and because I commit an entire work day to each case, I apply a minimum charge of 3 hours.

Clients (or their representative(s)) must have full authority to settle all issues raised by the pleadings or otherwise in the mediation session. This (authority to settle) is an essential element in the mediation process and must be satisfied by all parties.

FEES FOR ARBITRATION

My hourly rate for arbitration is $450.00, divided pro rata among the parties. This rate applies to the arbitration hearing, the time it takes me to prepare for it, including my review of materials submitted by the parties, and the time it takes to draft, review and publish the arbitration award.

The parties expressly agree to waive the fee limiting provisions of Chapter 49, Florida Statutes, section 44.103(3).

STATUTE AND RULES

The Arbitration will be conducted subject to and in accordance with Chapter 49, Florida Statutes or any other applicable state statute or rule or the rules mandated by the agreement to arbitrate.
